If you are using SoundVerse on behalf of an organization, you are agreeing to these terms for that organization and promising that you have the authority to bind that organization to these terms.
Your use of SoundVerse is subject to your compliance with all applicable laws and regulations. You agree not to use SoundVerse for any unlawful purpose or in any way that could harm, disable, overburden, or impair our platform. You also agree not to attempt to gain unauthorized access to any portion of SoundVerse or any other systems or networks connected to SoundVerse.
You must be at least 13 years old to use SoundVerse. If you are under 18, you must have the permission of a parent or guardian to use our services.
To access certain features of SoundVerse, you may be required to register an account. When you register, you agree to provide accurate, current, and complete information about yourself and to keep this information up to date. You are responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account. SoundVerse Inc. is not liable for any loss or damage arising from your failure to protect your account credentials. We reserve the right to suspend or terminate your account if we believe that you have violated these Terms and Conditions.
SoundVerse respects the intellectual property rights of others and expects our users to do the same. All content available on SoundVerse, including but not limited to podcasts, episodes, artwork, and written materials, is protected by copyright and other intellectual property laws. The ownership of this content resides with the respective creators and licensors.
If you are a content creator using SoundVerse, you retain ownership of your original content. By uploading content to SoundVerse, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with the operation of SoundVerse. This license allows us to host your content, make it available to users, and promote SoundVerse.
You are responsible for ensuring that you have all necessary rights and permissions to upload and distribute your content on SoundVerse. You agree not to upload any content that infringes the intellectual property rights of others or violates any applicable laws or regulations. SoundVerse Inc. has the right to remove any content that violates these terms.
You agree to use SoundVerse in a responsible and respectful manner. You are solely responsible for your conduct and any content that you upload, post, or otherwise transmit through our platform. You agree not to:
SoundVerse Inc. reserves the right to monitor user conduct and to remove any content that violates these Terms and Conditions. We may also suspend or terminate your account if we believe that you have engaged in unacceptable behavior.
SoundVerse Inc. provides the platform on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the operation of SoundVerse or the content available on our platform. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In no event shall SoundVerse Inc., its officers, directors, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of SoundVerse. This includes, but is not limited to, damages for loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages.
Our liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to SoundVerse Inc. for your use of the platform during the six (6) months prior to the event giving rise to liability.
SoundVerse Inc. reserves the right to terminate your access to our platform at any time, with or without cause. We may terminate your account if we believe that you have violated these Terms and Conditions or engaged in any conduct that is harmful to SoundVerse or other users. You may terminate your account at any time by contacting our support team at [email protected].
Upon termination of your account, all licenses and rights granted to you under this Agreement will immediately cease. We may retain your content for a reasonable period of time for archival purposes, but we have no obligation to do so. We may also delete your content at any time, with or without notice.
This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located in San Francisco, California, and you consent to the jurisdiction of such courts.
SoundVerse Inc. reserves the right to modify or update these Terms and Conditions at any time. We will notify you of any material changes by posting the updated terms on our website and/or by sending you an email. Your continued use of SoundVerse after the effective date of any changes constitutes your acceptance of the revised terms. It is your responsibility to review these Terms and Conditions periodically for any updates or changes.
